Day six of appeal procedure
Friday, March 23 was the sixth day of Peike’s appeal. Again, there were many supporters in court and the solidarity booth of United We Stand was again present from 8 o’clock in the morning.
In the short session (9: 15-10: 45), the last part of Marx’s testimony was heard by the defense. The defense continued pressing for details and again Marx could not ‘remember’ many of them. From each session it is becoming increasingly clear that the two witnesses no longer know who they were working with that day. Like Kosnik, Marx remembers nothing about who was around him, with whom he was in the group, who assisted him in the arrest, search and transport and with whom he had contact about the incident. So there are no new names of cops who might have seen the course of the events surrounding Peike’s arrest.
When there were no more questions for Marx, the defense continued with a summary of the testimony of Kosnik from the first, fourth and fifth day of the appeal. This was followed with the defense’s request to hear other cops as witnesses, who could possibly give more concrete information, since Kosnik had lost sight of the person he wanted to arrest, both immediately and after the incident, and also recalls nothing more about most things. In response, the prosecutor stated that the witnesses who have now been heard have given enough information. He then asked the judge to therefore not grant permission for new witnesses.
The hearing was then closed. Wednesday next week the judge will give her decision regarding defense’s request. The defense will then also give a report of both the testimonies of the two cops. Hopefully it will become more clear how the five upcoming trial days will be structured.
Onward to Peike’s freedom, stand in solidarity with him and come to one of the hearings!
